AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 3831 creates the Monticello Municipal Management District No. 1 over approximately 292 acres within the City of El Paso.  The purpose of the district is to provide improvement projects and services that confer a special benefit to property in the district and to pay for such projects and services through assessments or taxes.

 

H.B. 3831 amends current law relating to the creation of the Montecillo Municipal Management District No. 1 and provides authority to levy an assessment, impose a tax, and issue bonds.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or ageny.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subtitle C, Title 4, Special District Local Laws Code, by adding Chapter 3900, as follows:

 

CHAPTER 3900.  MONTECILLO MUNICIPAL MANAGEMENT DISTRICT NO. 1

 

Sets forth the standard language for the creation of the Montecillo Municipal Management District No. 1 (district).  Sets forth standards, procedures, requirements, and criteria for:

 

General provisions of the district (Sections 3900.001-3900.050);

 

Board of directors of the district (Sections 3900.051-3900.100);

 

Powers and duties of the district (Sections 3900.101-3900.150);

 

General financial provisions; assessments of the district (Sections 3900.151-3900.200); and

 

Taxes and bonds (Sections 3900.201-3900.208).

 

Prohibits the district from exercising the power of eminent domain.

 

SECTION 2.  Sets forth the initial boundaries of the district.

 

SECTION 3.  Provides that all requirements of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date:  September 1, 2011.
