BACKGROUND AND PURPOSE

 

Interested parties have identified the need to compensate the board of directors of the Lake View Management and Development District in the manner provided by law for other conservation and reclamation districts.  H.B. 3848 seeks to add provisions to the statute governing compensation of the board of directors of the Lake View Management and Development District that are consistent with that law.     

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3848 amends the Special District Local Laws Code to entitle a director of the board of directors of the Lake View Management and Development District to receive fees of office of not more than $150 a day for each day the director spends performing the duties of a director.  The bill defines "performing the duties of a director."  The bill removes language establishing that a director is not entitled to compensation for service on the board.  The bill requires the board by resolution to set a limit on the fees of office that a director may receive in a year and prohibits the board from setting the limit at more than $7,200.  The bill requires a director to file with the district a verified statement showing the number of days spent performing the duties of a director and a general description of the duties performed for each day of service to receive compensation or reimbursement for expenses.  The bill makes nonsubstantive changes.

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
