BACKGROUND AND PURPOSE

 

Interested parties contend that while certain areas of the Galveston County Municipal Utility District No. 6 have retired debt used to fund infrastructure in those areas, certain district residents are still taxed to pay debt used to fund infrastructure in other areas of the district.  H.B. 3849 seeks to address this issue by establishing provisions relating to the powers and duties of the district and providing for the establishment and administration of defined areas.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

H.B. 3849 amends the Special District Local Laws Code to establish that the Galveston County Municipal Utility District No. 6 has the powers and duties provided by the general law of the state applicable to municipal utility districts created under constitutional provisions relating to conservation and reclamation districts.  The bill authorizes the district to establish and administer defined areas as provided by municipal utility district provisions relating to services for certain defined areas and designated property. The bill makes the limitation on acreage provided by provisions relating to the authority to establish defined areas or designated property inapplicable to the district.  The bill defines "district."

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
