AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Interested parties contend that the majority of general elections are held in November of even-numbered years and that more people tend to vote in November elections as opposed to elections held in other months.  H.B. 3866 seeks to establish provisions relating to the date for the election of directors of the Hill Country Underground Water Conservation District with a goal of providing cost savings to the various entities that share in the performance and function of elections and an opportunity for higher voter turnout.

 

H.B. 3866 amends current law relating to the date for the election of directors of the Hill Country Underground Water Conservation District.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 8844.104, Special District Local Laws Code, as follows:

 

Sec. 8844.104.  ELECTION DATE.  Requires the board of directors of the Hill County Underground Water Conservation District (board; district), each even-numbered year, rather than each odd-numbered year, to hold an election in the district on the uniform election date in November, rather than in May, to elect the appropriate number of directors.

 

SECTION 2.  Provides that notwithstanding Section 8844.102 (Terms), Special District Local Laws Code:

 

(1)   a member of the board elected in May 2009, is required to serve until the member's successor has qualified following the directors' election held on the uniform election date in November 2012 in accordance with Section 8844.104, Special District Local Laws Code, as amended by this Act; and

 

(2)   a member of the board elected in May 2011, is required to serve until the member's successor has qualified following the directors' election held on the uniform election date in November 2014 in accordance with Section 8844.104, Special District Local Laws Code, as amended by this Act.

 

SECTION 3.  Provides that all requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 4.  Effective date: upon passage or September 1, 2011.
