AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Promoting Independence Advisory Committee (PIAC) was set to expire on September 1, 2011, but the executive commissioner of the Health and Human Services Commission (HHSC), Tom Suehs, took action to extend it.  Expiration of the committee would result in the discontinuation of critical recommendations made to HHSC and health and human services agencies.  These recommendations address the most appropriate methods of assisting persons with disabilities.  PIAC is able to make recommendations that staff from the relevant health and human services entities cannot because of a "lack of legislative direction."

 

Extending the statutory authority of PIAC will ensure there are continued recommendations made to HHSC indefinitely regarding the appropriate care settings for persons with disabilities.

 

S.B. 37 amends current law relating to the duration of the interagency task force on ensuring appropriate care settings for persons with disabilities.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 531.02441, Government Code, by adding Subsection (j), to provide that this section (relating to an interagency task force on ensuring appropriate care settings for persons with disabilities) expires September 1, 2017.

 

SECTION 2. Effective date: upon passage or on the 91st day after the last day of the legislative session.
