Current law authorizes counties to refuse to register a vehicle to a person with an outstanding warrant for failure to appear or failure to pay a fine relating to a traffic violation by a municipality. However, only home-rule municipalities may take advantage of the program. This bill expands the Scofflaw Program to include general-law municipalities.
As proposed, S.B. 86 amends current law relating to municipal contracts for enforcement of outstanding traffic violation arrest warrants.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
S.B. 86 repeals Section 702.002, Transportation Code, removing the application clause allowing only home-rule municipalities to refuse to register vehicles to individuals with outstanding warrants for failure to appear or failure to pay a fine relating to a traffic violation by a municipality.
EFFECTIVE DATE
Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2011.
