BACKGROUND AND PURPOSE

 

Chapter 1053 of the Texas Special District Local Laws Code is the enabling statute for the Lubbock County Hospital District.  In 1999, the 76th Legislature amended the enabling legislation to add an additional board member appointed by the Texas Tech University Board of Regents.  This board member is a non-voting member of the board.

The original statute established a board of not fewer than five and not more than seven managers.  Since the amendment, the Lubbock County Commissioners Court has continued to appoint seven members to the board and the Texas Tech University Board of Regents to appoint one non-voting member.  This results in eight members, exceeding the current statutory limit. 

S.B. 398 amends the enabling statute for the Lubbock County Hospital District to allow for the appointment of not fewer than six and not more than eight managers to the board. 

As proposed, S.B. 398 amends current law relating to the board of hospital managers of the Lubbock County Hospital District.

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

ANALYSIS

 

SECTION 1.  Amends Section 1053.051(a), Special District Local Laws Code, to provide that the board of hospital managers of the Lubbock County Hospital District consists of not fewer than six, rather than not fewer than five, and not more than eight, rather than not more than seven, managers appointed as provided.

EFFECTIVE DATE

 

SECTION 2.  Effective date: upon passage or September 1, 2011.
