AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Red River Redevelopment Authority (authority) was created by the legislature in 1997, in response to the closure of part of the Red River Army Depot.  The redeveloped site was named the Red River Commerce Park, consisting of 765 acres in Bowie County.  In 2005, the federal Base Realignment and Closure Act resulted in the closure of the Lone Star Ammunition Plant and additional acreage becoming available for redevelopment.  In 2010, the authority acquired approximately 8,000 acres, and in 2011, another 3,000 acres will be added.

 

The Red River Commerce Park has recently been "rebranded" as the TexAmericas Center.  S.B. 410 amends relevant statutes to reflect the new name of the facility and make other updates.

 

As proposed, S.B. 410 amends current law relating to the name and powers of the Red River Redevelopment Authority.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends the heading to Chapter 3503, Special District Local Laws Code, to read as follows:

CHAPTER 3503.  TEXAMERICAS CENTER

 

SECTION 2.  Amends Section 3503.001(1), Special District Local Laws Code, to redefine "authority" as the TexAmericas Center, rather than the Red River Redevelopment Authority.

 

SECTION 3.  Amends Subchapter C, Chapter 3503, Special District Local Laws Code, by adding Section 3503.110, as follows:

 

Sec. 3503.110.  ASSUMED NAME.  Authorizes the authority to conduct business under an assumed name by filing an assumed name certificate under Subchapter C (Requirements Applicable to Incorporated Business or Profession and Certain Other Entities), Chapter 71 (Assumed Business or Professional Name), Business & Commerce Code, and complying with that chapter in the same manner as an incorporated business.

 

SECTION 4.  Amends Section 9601.005(a), Special District Local Laws Code, to provide that the Riverbend Water Resources District (district) is composed of, among other members, the TexAmericas Center, rather than the Red River Redevelopment Authority.

 

SECTION 5.  Amends Section 9601.006(a), Special District Local Laws Code, to provide that the territory of the district is composed of all the territory, contained in certain cities and the TexAmericas Center, rather than the Red River Redevelopment Authority, the boundaries of which are described by Section 3503.004 (Authority Territory), including territory that has been or may be added under Section 3503.005 (Expansion Territory).

 

SECTION 6.  Repealer:  Section 3503.153 (Transfer of Assets by County), Special District Local Laws Code.

 

SECTION 7.  Provides that a reference in law to the Red River Redevelopment Authority means the TexAmericas Center.

 

SECTION 8.  Effective date: upon passage or September 1, 2011.
