BACKGROUND AND PURPOSE
S.B. 436 seeks to provide for the authority of certain counties to inspect day-care centers and group day-care homes located in certain municipalities.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
S.B. 436 amends the Local Government Code to authorize a county health officer or official designated by the commissioners court of a county with a population of 700,000 or more to contract with a municipality for the county to conduct an inspection required by the municipality of a day-care center or group day-care home located in the municipality. The bill provides for the meanings of "day-care center" and "group day-care home" by reference to the Human Resources Code.

On passage, or, if the bill does not receive the necessary vote, September 1, 2011.
