AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

This bill repeals two paragraphs and two sections of Chapter 16 (Winery Permit), Alcoholic Beverage Code.  The repealed provisions are repeated elsewhere in unrepealed portions of Chapter 16.  S.B. 621 removes redundant provisions of the Alcoholic Beverage Code.

 

As proposed, S.B. 621 amends current law relating to the authorized activities of a winery permit holder.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Repealer:  Section 16.01(d) (relating to authorizing the holder of a winery permit to sell wine to ultimate consumers for consumption on or off winery premises and dispense free wine for consumption on or off the winery premises), Alcoholic Beverage Code.

 

Repealer: Section 16.01(e) (relating to authorizing the holder of a winery permit to dispense wine for consumption on the premises of the winery), Alcoholic Beverage Code.

 

Repealer: Section 16.07 (Wine Sampling), Alcoholic Beverage Code.

 

Repealer: Section 16.08 (Wine Festivals), Alcoholic Beverage Code. 

 

SECTION 2.  Effective date: September 1, 2011.
