AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 764 prohibits a school board from imposing taxes, issuing bonds, and authorizing the use of school district employees or school district property, money, or other resources to acquire property to build and operate a hotel.  The bill also precludes school boards from entering into any type of lease agreement for hotels.

 

S.B. 764 amends current law relating to a prohibition against use of school district resources for a hotel.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter D, Chapter 11, Education Code, by adding Section 11.178, as follows:

 

Sec. 11.178.  PROHIBITION AGAINST USE OF SCHOOL DISTRICT RESOURCES FOR HOTEL.  (a)  Defines, in this section, "hotel."

 

(b)  Prohibits the board of trustees of an independent school district (board) from imposing taxes, issuing bonds, using or authorizing the use of school district employees, using or authorizing the use of school district property, money, or other resources, or acquiring property for the design, construction, renovation, or operation of a hotel.

 

(c)  Prohibits the board from entering a lease, contract, or other agreement that obligates the board to engage in an activity prohibited by Subsection (b), or obligates the use of district employees or resources in a manner prohibited by Subsection (b).

 

SECTION 2.  Provides that Section 11.178(c), Education Code, as added by this Act, applies only to an agreement concerning the use of school district resources for a hotel that is entered into on or after the effective date of this Act.  Provides that an agreement concerning the use of school district resources for a hotel that is entered into before the effective date of this Act is governed by the law in effect on the date the agreement was entered into, and the law is continued in effect for that purpose.

 

SECTION 3.   Effective date:  upon passage or September 1, 2011.
