AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The purpose of the proposed legislation is to establish legislatively the boundaries of the El Paso County Water Control and Improvement District No. 4 (district).  H.B. 3207 from 1989 (Chapter 529, Acts of the 71st Legislature, Regular Session) attempted to do so by excluding certain territory from the Lower Valley Water District which surrounds the district, but that law failed to state that the excluded territory made up the outer boundaries of the district.  S.B. 765 delineates the boundaries of the district.

 

As proposed, S.B. 765 amends current law relating to the territory of the El Paso County Water Control and Improvement District No. 4.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 58, Acts of the 54th Legislature, Regular Session, 1955, by adding Section 2A, as follows:

 

Sec. 2A.  (a) Provides that in this section, "district" means the El Paso County Water Control and Improvement District No. 4.

 

(b) Provides that the district is composed of the territory described by Subsection (d) of this section.

 

(c) Provides that the boundaries and field notes contained in Subsection (d) of this section form a closure.  Provides that a mistake made in the field notes or in copying the field notes in the legislative process does not affect the district's:

 

(1) organization, existence, or validity;

 

(2) right to issue any type of bond for the purposes for which the district is created or to pay the principal of and interest on a bond;

 

(3) right to impose a tax; or

 

(4) legality or operation.

 

(d) Sets forth the initial boundaries of the district.

 

SECTION 2.  Provides that all requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 3. Effective date: upon passage or September 1, 2011.
