AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Under current law there is some confusion about what the definition of "venue" found in Section 334.001 (Definitions), Local Government Code, encompasses. S.B. 803 would amend the statute to clarify that, in Aransas County, the definition of "venue" encompasses tourism development projects such as a park, aquarium, birding center, bird viewing site, history center, art center, nature center, nature trail, museum, or water-related project that creates or enhances an activity involving water sports or fishing.
As proposed, S.B. 803 amends current law relating to venue projects in certain counties.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subchapter A, Chapter 334, Local Government Code, by adding Section 334.0083, as follows:
Sec. 334.0083. VENUE PROJECTS IN CERTAIN COUNTIES. (a) Authorizes a county with a population of 50,000 or less in which at least one state park and one national wildlife refuge are located, to plan, acquire, establish, develop, construct, or renovate a venue as described by Subsection (b) as a venue project under this chapter.
(b) Defines "venue" in this section.
SECTION 2. Effective date: upon passage or September 1, 2011.
