AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, the secretary of state updates the statewide voter registration list upon receipt of death notices from local officials as well as the State Bureau of Vital Statistics. 

 

S.B. 1046 amends current law relating to information regarding deceased registered voters.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 16.001, Election Code, by adding Subsection (d), as follows::

 

(d)  Requires the secretary of state (SOS) to quarterly obtain from the United States Social Security Administration available information specified by SOS relating to deceased residents of the state and to compare the information received to the statewide computerized voter registration list.  Requires SOS, if SOS determines that a voter on the registration list is deceased, to send notice of the determination to the voter registrar of the counties considered appropriate by SOS.

 

SECTION 2.  Amends Section 16.031(b), Election Code, to require the registrar to cancel a voter's registration immediately under certain circumstances, including if the registrar receives notice from SOS under Section 16.001(d) that the voter is deceased.

 

SECTION 3.  Effective date:  upon passage or September 1, 2011.
