AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

In 2001, the legislature required the Health and Human Services Commission (HHSC) to conduct a review of rate and expenditure disparities between the Texas-Mexico border region and other areas of the state, both for Medicaid and the child health plan program.  This bill extends the provisions set to expire on September 1, 2011, and requires HHSC to report to the legislature no later than December 1, 2014, on how it plans to eliminate disparities in rates and expenditures.

 

S.B. 1220 amends current law relating to the advisory committee on Medicaid and child health plan program rate and expenditure disparities between the Texas-Mexico border region and other areas of the state.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 531.0223(a)(2), Government Code, to redefine, in this section,  "committee."

 

SECTION 2.  Amends Sections 531.0023(b)-(e), (o), and (p), Government Code, as follows:

 

(b) Requires the executive commissioner of the Health and Human Services Commission (executive commissioner; HHSC) to appoint an advisory committee to develop a strategic plan for eliminating the disparities between the Texas-Mexico border region and other areas of the state in certain expenditures.

 

(c)-(e) Makes conforming changes.

 

(o) Requires HHSC, rather than requires HHSC to contract with a public university, to take certain actions, including measure changes occurring from September 1, 2002, to August 31, 2014, rather than September 1, 2001, to August 31, 2004, in the number of health care providers participating in the Medicaid program or the child health plan program in the Texas-Mexico border region and resulting effects on consumer access to health care and consumer utilization, and not later than December 1, 2014, rather than December 1, 2004, submit a report to the legislature.

 

(p)  Provides that this section expires September 1, 2015, rather than September 1, 2011.

 

SECTION 3.  Provides that the advisory committee on Medicaid and child health plan program rate and expenditure disparities between the Texas-Mexico border region and other areas of the state is re-created in accordance with Section 531.0223, Government Code, as amended by this  Act.  Requires the executive commissioner, not later than December 1, 2011, to appoint the members of the advisory committee as required by that section.

 

SECTION 4.  Effective date: upon passage or on the 91st day after the last day of the legislative session.
