BACKGROUND AND PURPOSE

 

Some concrete crushing facilities in certain areas of the state recycle concrete into green products and have been steady sources of employment. Interested parties report that generally, employment opportunities increase when these facilities are permitted to grow.  C.S.S.B. 1250 seeks to provide additional guidance relating to the applicability of certain restrictions on the location and operation of concrete crushing facilities.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.S.B. 1250 amends the Health and Safety Code to make a provision prohibiting, under certain conditions, the operation of a concrete crushing facility within 440 yards of a building in use as a single or multifamily residence, school, or place of worship inapplicable to a concrete crushing facility that uses a concrete crusher in the manufacture of products that contain recycled materials and that is located in an enclosed building and is located within 25 miles of an international border and in a municipality with a population of not less than 6,100 but not more than 20,000.

September 1, 2011.

 

COMPARISON OF ORIGINAL AND SUBSTITUTE

 

C.S.S.B. 1250 differs from the original by making a provision of law prohibiting, under certain conditions, the operation of a concrete crushing facility within 440 yards of a building in use as a single or multifamily residence, school, or place of worship inapplicable to a concrete crushing facility that uses a concrete crusher in the manufacture of products that contain recycled materials and that is located in an enclosed building and, rather than "or" as in the original, is located within 25 miles of an international border and in a municipality with a population of not less than 6,100 but not more than 20,000.
