AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Under current law, concrete crushing facilities are prohibited from operation within 440 yards of a building in use as a single family or multifamily residence, school, or place of worship.

 

C.S.S.B. 1250 amends current law relating to the applicability of certain restrictions on the location and operation of concrete crushing facilities.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 382.065(b), Health and Safety Code, as follows: 

 

(b) Provides that Subsection (a) (relating to concrete crushing facility distance from certain buildings and the measurement of distance) does not apply to a concrete crushing facility at certain locations, including a location that uses a concrete crusher in the manufacture of products that contain recycled materials, and that is located in an enclosed building, or at a location within 25 miles of a international border, and in a municipality with a population of not less than 6,100 but not more than 20,000.  Makes  nonsubstantive changes.

 

SECTION 2.  Effective date:  September 1, 2011.
