AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Current law requires that a driver's license or commercial driver's license (CDL) include a color photograph. S.B. 1532 authorizes, but does not require, the Texas driver's license program to issue a personal identification certificate, driver's license, or CDL with a grayscale photograph.
S.B. 1532 allows the Department of Public Safety of the State of Texas to comply with the Association of American Motor Vehicle Administrators 2010 Driver's License standards by adding language to permit the use of a laser-engraved photograph on a personal identification certificate, driver's license, or CDL.
As proposed, S.B. 1532 amends current law relating to a photograph on a personal identification certificate, driver's license, or commercial driver's license.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 521.101, Transportation Code, by adding Subsection (k), to authorize the Department of Public Safety of the State of Texas (DPS) to include a color or grayscale photograph of the holder of the personal identification certificate.
SECTION 2. Reenacts Section 521.121(a), Transportation Code, as amended by Chapters 316 (H.B. 598) and 1146 (H.B. 2730), Acts of the 81st Legislature, Regular Session, 2009, and amends it to require that the driver's license include, among certain information, a color or grayscale photograph of the entire face of the holder.
SECTION 3. Amends Section 522.030, Transportation Code, to require that a commercial driver's license include, among certain information, the person's color or grayscale photograph.
SECTION 4. Provides that the changes in law made by this Act apply only to a driver's license, personal identification certificate, or commercial driver's license issued or renewed on or after the effective date of this Act. Provides that a driver's license, personal identification certificate, or commercial driver's license issued or renewed before the effective date of this Act is governed by the law in effect when the license or certificate was issued, and the former law is continued in effect for that purpose.
SECTION 5. Provides that, to the extent of any conflict, this Act prevails over another Act of the 82nd Legislature, Regular Session, 2011, relating to nonsubstantive additions to and corrections in enacted codes.
SECTION 6. Effective date: September 1, 2011.
