AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1706 allows the Cameron County Regional Mobility Authority (authority) to enter into public private partnerships for the purpose of mobility relief on a segment of United States (U.S.) Highway 77.  This project is a segment of approximately 28 miles that lies between the towns of Riviera and Driscoll with portions located in Kleberg and Nueces counties.  Allowing the authority to enter into a public private partnership will help get the project completed as soon as possible.  This project will bring this segment of U.S. Highway 77 to interstate quality.

 

As proposed, S.B. 1706 amends current law relating to certain comprehensive development agreements of regional mobility authorities.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter G, Chapter 370, Transportation Code, by adding Section 370.3052, as follows:

 

Sec. 370.3052.  LIMITED AUTHORITY FOR CERTAIN PROJECTS USING COMPREHENSIVE DEVELOPMENT AGREEMENTS.  Authorizes a regional mobility authority, notwithstanding Sections 370.305(d) (relating to the expiration of the authority to enter into comprehensive development agreements) and (f) (relating to the expiration of the authority to enter into comprehensive development agreements), to enter into a comprehensive development agreement relating to improvement to the U.S. Highway 77 Driscoll and Riviera highway relief routes.

 

SECTION 2.  Effective date: upon passage or September 1, 2011.
