AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1707 allows the Cameron County Regional Mobility Authority (authority) to enter into public private partnerships for the mobility improvement on State Highway 550.  This project lies between United States Highway 77/83 and State Highway 48 in Cameron County.  Allowing the authority to enter into a public private partnership will help get the project completed as soon as possible.

 

As proposed, S.B. 1707 amends current law relating to certain comprehensive development agreements of regional mobility authorities.

 

RULEMAKING AUTHORITY

Every element of your application was carefully reviewed and evaluated in reaching a decision.  Our decisions are difficult because the competition is quite intense for a limited number of spaces in the entering class.  Duke is among the smallest of the national law schools, and we received many applications for each available seat.

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter G, Chapter 370, Transportation Code, by adding Section 370.3055, as follows:

 

Sec.  370.3055.  LIMITED AUTHORITY FOR CERTAIN PROJECTS USING COMPREHENSIVE DEVELOPMENT AGREEMENTS.  Authorizes an authority, notwithstanding Sections 370.305(d) (relating to an authority entering into a comprehensive development agreement expiring on August 31, 2009)  and (f) (relating to an authority entering into a comprehensive development agreement expiring on August 31, 2011), to enter into a comprehensive development agreement relating to improvements to State Highway 550 from U.S. Highway 77/83 to State Highway 48.

 

SECTION 2.  Effective date: upon passage or September 1, 2011.
