AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, the Juvenile Board in Fannin County consists of the county judge and the district judges in Fannin County.  Under current statute, the board is not subject to the standard requirements pertaining to quarterly meetings, general expenses, reimbursements for job-related expenses, staff, and general duties of the board.

 

S.B. 1886 provides that the Fannin County Juvenile Board is subject to Subchapter B (Creation of Juvenile board in Certain Counties), Chapter 152 (Juvenile Boards), Human Resources Code, and strikes language exempting the board from Sections 152.002 (Board Meetings), 152.004 (General Expenses), 152.005 (Expenses of Board Members and Juvenile Court), 152.006 (Fiscal Officer), 152.007 (Duties), and 152.008 (Personnel) of the code.

 

As proposed, S.B. 1886 amends current law relating to the Fannin County Juvenile Board.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 152.0031, Human Resources Code, as follows:

 

Sec. 152.0031.  APPLICATION OF SUBCHAPTER. Provides that, except as otherwise provided by this chapter, this subchapter does not apply to a county that is served by a juvenile board created under Subchapter C (County Juvenile Board in Counties With a Family District Court) or D (Provisions Applicable to Specific Counties).  Makes a nonsubstantive change.

 

SECTION 2.  Amends Section 152.0801, Human Resources Code, as follows:

 

Sec. 152.0801.  FANNIN COUNTY. Deletes existing Subsection (a) designation. Provides that the Fannin County Juvenile Board is governed by Subchapter B (Creation of Juvenile board in Certain Counties).

 

Deletes existing text providing that the Fannin County Juvenile Board is composed of the county judge and the district judges in Fannin County.  Deletes existing Subsection (b) providing that the juvenile court judge is the chairman of the board and its chief administrative officer.  Deletes existing Subsection (c) authorizing the county commissioners court to pay the juvenile board chairman additional annual compensation of $1,200 for the added duties imposed on the chairman and to pay the other members of the board additional annual compensation of not more than $1,200.  Deletes existing text requiring the additional compensation to be paid in equal monthly installments from the general fund or any other available fund of the county.  Deletes existing Subsection (d) requiring the commissioners court to certify all claims for expenses of the juvenile probation officer as necessary in the performance of the officer's duties.  Deletes existing text requiring the commissioners court to provide the necessary funds to pay the salaries and expenses of the juvenile probation officer.  Deletes existing Subsection (e) providing that Sections 152.002 (Board Meetings), 152.004 (General Expenses), 152.005 (Expenses of Board Members and Juvenile Court), 152.006 (Fiscal Officer), 152.007 (Duties), and 152.008 (Personnel) do not apply to the juvenile board of Fannin County.  Makes nonsubstantive changes.

 

SECTION 3.  Effective date: upon passage or September 1, 2011.
