A BILL TO BE ENTITLED
 
AN ACT
  relating to the disconnection of retail electric service on certain
  days of the week.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 182, Utilities Code, is amended by
  adding Subchapter D to read as follows:
  SUBCHAPTER D. CUSTOMER SAFEGUARDS DURING DISCONNECTION OF UTILITY
  SERVICE
         Sec. 182.151.  DEFINITIONS. In this subchapter:
               (1)  "Commission" means the Public Utility Commission
  of Texas.
               (2)  "Electric provider" means a public or private
  entity that provides retail electric service in this state. The
  term includes a municipally owned utility, electric cooperative,
  retail electric provider, and electric utility.
         Sec. 182.152.  DISCONNECTION PROHIBITED ON CERTAIN DAYS. An
  electric provider may not disconnect service to a residential
  customer on a Friday, Saturday, Sunday, Federally declared holiday,
  the day before the Federally declared holiday, or after 3:00 pm on
  any calendar day.
         Sec. 182.153.  ADDITIONAL SAFEGUARDS. (a) The customer
  safeguards provided by this subchapter are in addition to
  safeguards provided by other law, including Section 39.101 and
  commission rules.
         (b)  This subchapter does not prohibit a municipality, an
  electric cooperative, or the commission from adopting customer
  safeguards that exceed the safeguards provided by this subchapter.
         SECTION 2.  This Act takes effect September 1, 2011.
