A BILL TO BE ENTITLED
 
AN ACT
  relating to certain purchases by a state agency performing a law
  enforcement function.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 2155, Government Code, is
  amended by adding Section 2155.151 to read as follows:
         Sec. 2155.151.  CERTAIN PURCHASES BY STATE AGENCY PERFORMING
  LAW ENFORCEMENT FUNCTIONS. The governing body of a state agency
  that performs a law enforcement function is exempt from the
  purchasing procedures under this subtitle or Chapter 2252 for the
  purpose of purchasing equipment related to the agency's law
  enforcement functions if the governing body determines that
  following those procedures would negatively impact homeland
  security or impair the agency's ability to perform the agency's law
  enforcement functions.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
