A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to requiring certain students leaving public school to |
|
provide documentation necessary to ensure an accurate calculation |
|
of dropout rates. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 25, Education Code, is |
|
amended by adding Section 25.0861 to read as follows: |
|
Sec. 25.0861. DOCUMENTATION REQUIREMENTS FOR STUDENT |
|
LEAVING SCHOOL TO RECEIVE HOME-SCHOOL INSTRUCTION. (a) In this |
|
section, "qualified student" means a student who: |
|
(1) is married; |
|
(2) is 18 years of age or older; or |
|
(3) has established a residence separate from the |
|
student's parent, guardian, or other person having lawful control |
|
of the student. |
|
(b) This section applies only to a student previously |
|
enrolled in a public school who, for the purpose of receiving |
|
home-school instruction, withdraws from or otherwise no longer |
|
attends public school. To satisfy documentation requirements for |
|
data reported under the Public Education Information Management |
|
System (PEIMS), a school shall, within the period prescribed by |
|
commissioner rule, obtain regarding a student described by this |
|
subsection documentation that: |
|
(1) is in writing; |
|
(2) includes a statement of intent for the student to |
|
receive home-school instruction; and |
|
(3) is signed and dated by: |
|
(A) the student's parent, guardian, or other |
|
person having lawful control of the student or the student if the |
|
student is a qualified student; and |
|
(B) an authorized representative of the school |
|
district. |
|
(c) A document provided to a school under Subsection (b) is |
|
not a public record and is not subject to release under Chapter 552, |
|
Government Code. |
|
(d) Not later than January 1, 2012, the commissioner shall |
|
amend rules regarding the Public Education Information Management |
|
System (PEIMS) as necessary to conform to the requirements of this |
|
section. This subsection expires January 31, 2012. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
