A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to foster care payments for certain children. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 264.101(a-2), Family Code, is amended to |
|
|
read as follows: |
|
|
(a-2) The department shall continue to pay the cost of |
|
|
foster care under: |
|
|
(1) Subsection (a-1)(1) until: |
|
|
(A) the last day of the third full month after the |
|
|
date the child receives a high school diploma or high school |
|
|
equivalency certificate; or |
|
|
(B) the last day of the month in which the child |
|
|
attains the age of 22 if the child has not received a high school |
|
|
diploma or high school equivalency certificate; and |
|
|
(2) Subsections (a-1)(2)-(5) until the last day of the |
|
|
month the child attains the age of 21. |

|
SECTION 2. The change in law made by this Act applies to |
|
|
foster care payments for a child who is in foster care on or after |
|
|
the effective date of this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
