A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to reports to the legislature on certain administrative |
|
|
hearings regarding the automatic suspension of a person's driver's |
|
|
license. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 524, Transportation Code, |
|
|
is amended by adding Section 524.045 to read as follows: |
|
|
Sec. 524.045. QUARTERLY REPORTS TO LEGISLATURE. (a) Not |
|
|
later than the 30th day following the end of each calendar quarter, |
|
|
the State Office of Administrative Hearings shall submit a report |
|
|
to the legislature indicating for each county the total number of |
|
|
administrative hearings decided under this chapter during the |
|
|
previous calendar quarter and, of those hearings: |
|
|
(1) the percentage in which the administrative law |
|
|
judge decided in favor of the person who requested the hearing; and |
|
|
(2) the percentage in which the administrative law |
|
|
judge decided in favor of the department. |
|
|
(b) Not later than the 30th day following the end of each |
|
|
calendar quarter, the department shall submit a report to the |
|
|
legislature indicating for each county the total number of appeals |
|
|
from administrative hearings held under this chapter that were |
|
|
decided during the previous calendar quarter and, of those appeals: |
|
|
(1) the percentage in which the court decided in favor |
|
|
of the person whose license was suspended; and |
|
|
(2) the percentage in which the court decided in favor |
|
|
of the department. |
|
|
SECTION 2. The State Office of Administrative Hearings and |
|
|
the Department of Public Safety shall submit the initial reports |
|
|
required by Section 524.045, Transportation Code, as added by this |
|
|
Act, not later than January 30, 2012, based on data from the |
|
|
previous calendar quarter. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
