A BILL TO BE ENTITLED
 
AN ACT
  relating to the areas in which a freight rail district may be
  created.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 171.051, Transportation Code, is amended
  to read as follows:
         Sec. 171.051.  APPLICABILITY TO CERTAIN COUNTIES. A
  district may be created only in:
               (1)  a county with a population of 3.3 million or more
  and counties adjacent to such a county; or
               (2)  a county with a population of 250,000 or more that
  borders a state of the United States, and counties adjacent to such
  a county.
         SECTION 2.  Section 171.052(a), Transportation Code, is
  amended to read as follows:
         (a)  The governing body of one or more counties and the most
  populous municipality in the most populous county may by concurrent
  order or ordinance create a district.  At the time of creation, a
  district must include:
               (1)  a county with a population of 3.3 million or
  more[;] and
               [(2)]  that municipality; or
               (2)  the most populous county described by Section
  171.051(2) and that municipality.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
