A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to certain restrictions on funds administered by the |
|
|
Department of Agriculture. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 12, Agriculture Code, is amended by |
|
|
adding Section 12.049 to read as follows: |
|
|
Sec. 12.049. LIMITATIONS ON RESTRICTIONS ON FUNDS |
|
|
ADMINISTERED BY DEPARTMENT. The distribution of money from a fund |
|
|
administered by the department to encourage private economic |
|
|
development may not be restricted on the basis of whether the county |
|
|
in which or to which the funds are distributed has adopted or |
|
|
enforces subdivision regulations, including the model rules |
|
|
established under Section 16.343, Water Code. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
