A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to requirements for providing documents and written |
|
information to certain owners of property subject to the exercise |
|
of eminent domain authority. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 21.0112, Property Code, is amended by |
|
amending Subsection (b) and adding Subsection (c) to read as |
|
follows: |
|
(b) The statement must [be]: |
|
(1) be printed in an easily readable font and type |
|
size; and |
|
(2) if the entity is a governmental entity: |
|
(A) be [,] made available on the Internet website |
|
of the entity if technologically feasible; and |
|
(B) include a provision informing the property |
|
owner that the entity is required to provide all documents and |
|
written information required under this chapter to be provided to |
|
the property owner printed in English, Spanish, or any other |
|
language requested by the property owner. |
|
(c) A governmental entity shall provide to a property owner |
|
all documents and written information required under this chapter |
|
to be provided to the property owner printed in English, Spanish, or |
|
any other language requested by the property owner. |
|
SECTION 2. The changes in law made by Section 21.0112, |
|
Property Code, as amended by this Act, apply only to a condemnation |
|
in which the final offer is made by a governmental entity on or |
|
after the effective date of this Act. A condemnation in which the |
|
final offer is made before the effective date of this Act is |
|
governed by the law in effect on the date the offer was made, and the |
|
former law is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2011. |
