A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the venue for the filing of certain applications by a |
|
|
pregnant minor with respect to an abortion. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 33.003(b), Family Code, is amended to |
|
|
read as follows: |
|
|
(b) If the minor resides in a county with a population of |
|
|
less than 50,000, the [The] application may be filed in any county |
|
|
court at law, court having probate jurisdiction, or district court, |
|
|
including a family district court, in this state. If the minor |
|
|
resides in a county with a population of 50,000 or more, the |
|
|
application must be filed in a county court at law, court having |
|
|
probate jurisdiction, or district court, including a family |
|
|
district court, in the county in which the minor resides. |
|
|
SECTION 2. This Act applies only to an application filed |
|
|
under Section 33.003, Family Code, on or after the effective date of |
|
|
this Act. An application filed before the effective date of this Act |
|
|
is governed by the law as it existed immediately before that date, |
|
|
and that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
