A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the authority of a municipality to regulate |
|
door-to-door solicitation and sales by an alarm systems company. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 1702.134, Occupations Code, is amended |
|
by amending Subsection (a) and adding Subsection (a-1) to read as |
|
follows: |
|
(a) Except as provided by Subsection (a-1), a [A] license |
|
holder or an employee of a license holder is not required to obtain |
|
an authorization, permit, franchise, or license from, pay another |
|
fee or franchise tax to, or post a bond in a municipality, county, |
|
or other political subdivision of this state to engage in business |
|
or perform a service authorized under this chapter. |
|
(a-1) An alarm systems company, including any employee or |
|
contractor of an alarm systems company, engaged in business or |
|
performing a service in a municipality must comply with any |
|
ordinance regulating the unsolicited promotion, sale, or offer for |
|
sale of goods or services in the municipality. |
|
SECTION 2. This Act takes effect September 1, 2011. |
