A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to provision by the secretary of state of notice to a |
|
|
candidate of the form of the candidate's name that will appear on |
|
|
the general election ballot. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 161.008, Election Code, is amended by |
|
|
adding Subsection (d) to read as follows: |
|
|
(d) Not later than the 30th day before the date the |
|
|
secretary of state makes a certification under this section, the |
|
|
secretary of state shall provide notice by e-mail to each candidate |
|
|
to be included in the certification who has provided an e-mail |
|
|
address for that purpose. The notice must: |
|
|
(1) contain the exact form for which the candidate's |
|
|
name will be certified for placement on the ballot; and |
|
|
(2) provide information to the candidate on how errors |
|
|
in the form of the candidate's name may be corrected. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
