A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the purchase of replacement personal computers by state |
|
agencies. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 2157, Government Code, is |
|
amended by adding Section 2157.007 to read as follows: |
|
Sec. 2157.007. PURCHASE OF PERSONAL COMPUTERS BY STATE |
|
AGENCY. (a) In this section: |
|
(1) "Personal computer" means a laptop, desktop, tower |
|
computer system, or other personal computer that contains a central |
|
processing unit, random access memory, and a storage device. |
|
(2) "State agency" does not include an institution of |
|
higher education as defined by Section 61.003, Education Code. |
|
(b) Except as provided by Subsection (c), a state agency may |
|
not purchase a new personal computer to replace an existing |
|
personal computer of the agency before the fourth anniversary of |
|
the date the existing personal computer was purchased. |
|
(c) A state agency may purchase a new personal computer to |
|
replace an existing personal computer of the agency before the |
|
fourth anniversary of the date the existing personal computer was |
|
purchased if the agency determines that the purchase is to be made |
|
under emergency circumstances as established by the comptroller. |
|
(d) The comptroller shall adopt rules establishing |
|
circumstances under which a state agency may make an emergency |
|
purchase under Subsection (c). |
|
SECTION 2. (a) This Act applies to a purchase made on or |
|
after August 1, 2012. A purchase made before August 1, 2012, is |
|
governed by the law as it existed immediately before the effective |
|
date of this Act, and that law is continued in effect for that |
|
purpose. |
|
(b) The comptroller shall adopt rules required by Section |
|
2157.007(d), Government Code, as added by this Act, not later than |
|
March 1, 2012. |
|
SECTION 3. This Act takes effect September 1, 2011. |
