A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to examinations for hiring in certain municipal fire |
|
departments. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 143.025, Local Government Code, is |
|
amended by amending Subsection (b) and adding Subsection (l) to |
|
read as follows: |
|
(b) An eligibility list for a beginning position in the fire |
|
or police department may be created only as a result of a |
|
competitive examination held in the presence of each applicant for |
|
the position, except as provided by Subsections (d), [and] (e), and |
|
(l). The examination must be based on the person's general |
|
knowledge and aptitude and must inquire into the applicant's |
|
general education and mental ability. A person may not be appointed |
|
to the fire or police department except as a result of the |
|
examination. |
|
(l) In a municipality with a population of more than 1.3 |
|
million and less than 2 million, an examination for a beginning |
|
position in the fire department may include testing instruments to |
|
be used in addition to the written examination in the establishment |
|
of the initial eligibility list. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
