A BILL TO BE ENTITLED
 
AN ACT
  relating to the allocation of certain federal career and technical
  education funds.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 7.109, Education Code, is amended by
  amending Subsection (d) and adding Subsections (e) and (f) to read
  as follows:
         (d)  The State Board for Career and Technology Education may
  allocate funds appropriated to the board by the legislature and
  shall allocate as provided by Subsection (f) [or] federal funds
  received by the board under the Carl D. Perkins Career and Technical
  [Vocational] Education Act of 2006 (20 U.S.C. Section 2301 et seq.)
  or other federal law to an institution or program approved by the
  State Board of Education, the Texas Higher Education Coordinating
  Board, or another state agency specified by law.
         (e)  For purposes of allocating federal funds described by
  Subsection (d), the State Board for Career and Technology Education
  shall determine the relative student utilization of approved career
  and technology education programs under Subsection (d). To assist
  the State Board for Career and Technology Education in making that
  determination, for each semester of each school year or academic
  year, as applicable:
               (1)  the agency shall calculate the number of full-time
  equivalent students enrolled at the secondary level in an approved
  career and technology education program; and
               (2)  the Texas Higher Education Coordinating Board
  shall calculate the number of full-time equivalent students
  enrolled at the postsecondary level in an approved career and
  technology education program.
         (f)  The agency and the Texas Higher Education Coordinating
  Board shall, at the time and in the manner prescribed by the State
  Board for Career and Technology Education, provide the calculations
  of student utilization of approved career and technology education
  programs under Subsection (e) to the State Board for Career and
  Technology Education. After receiving the calculations under this
  subsection, the State Board for Career and Technology Education
  shall determine the relative student utilization of approved career
  and technology education programs and allocate funding to support
  career and technology education at the secondary level and at the
  postsecondary level in proportion to that relative student
  utilization determination.
         SECTION 2.  The change in law made by this Act to Section
  7.109, Education Code, applies beginning with an allocation of
  federal funds made on or after the effective date of this Act,
  except that the State Board for Career and Technology Education, in
  making an allocation on or after that date, may allocate the funds
  in a manner that deviates from the requirements of Section 7.109,
  Education Code, as amended by this Act, to the extent necessary to
  comply with a grant awarded or an agreement entered into before the
  effective date of this Act under the Texas State Plan for Career and
  Technical Education, 2008-2013, or to comply with federal law.
         SECTION 3.  This Act takes effect September 1, 2011.
