A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a prohibition on the issuance of a drilling permit for |
|
|
an oil or gas well that is proposed to be located within a specified |
|
|
distance of a public school. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 38, Education Code, is |
|
|
amended by adding Section 38.027 to read as follows: |
|
|
Sec. 38.027. PROHIBITION ON PERMIT FOR OIL OR GAS WELL TO BE |
|
|
LOCATED NEAR PUBLIC SCHOOL. The Railroad Commission of Texas may |
|
|
not issue a drilling permit for an oil or gas well that is proposed |
|
|
to be located less than 1,200 feet from a public school. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a drilling permit the application for which is filed with the |
|
|
Railroad Commission of Texas on or after the effective date of this |
|
|
Act. A drilling permit the application for which is filed with the |
|
|
commission before the effective date of this Act is subject to the |
|
|
law in effect on the date the application is filed, and that law is |
|
|
continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
