A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the use of alternate electronic reporting databases for |
|
|
over-the-counter sales of ephedrine, pseudoephedrine, and |
|
|
norpseudoephedrine. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 486.005, Health and Safety Code, is |
|
|
amended by amending Subsection (b) and adding Subsection (b-1) to |
|
|
read as follows: |
|
|
(b) Except as provided by Subsection (b-1), this [This] |
|
|
chapter preempts and supersedes a local ordinance, rule, or |
|
|
regulation adopted by a political subdivision of this state |
|
|
pertaining to over-the-counter sales of products that contain |
|
|
ephedrine, pseudoephedrine, or norpseudoephedrine. |
|
|
(b-1) This section does not preclude a political |
|
|
subdivision from adopting an ordinance, rule, or regulation |
|
|
authorizing or requiring a business establishment in that political |
|
|
subdivision that engages in over-the-counter sales of products |
|
|
containing ephedrine, pseudoephedrine, or norpseudoephedrine to |
|
|
use an electronic reporting database in addition to any other |
|
|
reporting or recordkeeping required under this chapter. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
