A BILL TO BE ENTITLED
 
AN ACT
  relating to the purchase of iron, steel, and manufactured goods
  made in the United States for state construction projects.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter G, Chapter 2166, Government Code, is
  amended by adding Section 2166.3031 to read as follows:
         Sec. 2166.3031.  UNIFORM PURCHASING CONDITION. (a) Except
  as provided by Subsection (b), the uniform general conditions for a
  construction project in which iron, steel, or manufactured goods
  will be used must require that the bid documents provided to all
  bidders and the contract include a requirement that the iron,
  steel, and manufactured goods, including equipment, used in the
  project be produced in the United States.
         (b)  Subsection (a) does not apply to a project for which the
  governmental entity responsible for the project determines that:
               (1)  iron, steel, or specific manufactured goods are
  not produced in the United States in sufficient and reasonably
  available quantities and of a satisfactory quality; or
               (2)  inclusion of iron, steel, or specific manufactured
  goods produced in the United States will increase the total cost of
  the project by more than 25 percent.
         (c)  This section applies to a project otherwise exempted
  from the application of this chapter by Sections 2166.003 and
  2166.004.
         SECTION 2.  Section 2166.3031, Government Code, as added by
  this Act, applies only to bid documents submitted or contracts
  entered into on or after the effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2011.
