A BILL TO BE ENTITLED

AN ACT
|
|
relating to the provision of Internet service to consumers. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subtitle B, Title 10, Business & Commerce Code, |
|
is amended by adding Chapter 326 to read as follows: |
|
CHAPTER 326. PROVISION OF INTERNET SERVICE TO CONSUMERS |
|
Sec. 326.001. DEFINITION. In this chapter, "consumer" |
|
means an individual who seeks Internet service for personal, |
|
family, or household purposes. |
|
Sec. 326.002. INTERNET SERVICE WITHOUT CANCELLATION FEE. |
|
An Internet service provider may not offer to a consumer a contract |
|
for Internet service that provides: |
|
(1) any fee or charge for cancellation of the contract |
|
by the consumer; or |
|
(2) any period during which the contract is not |
|
subject to cancellation by the consumer. |
|
Sec. 326.003. CONTRACT VOID. A contract entered into in |
|
violation of Section 326.002 is void and may not be enforced. |
|
SECTION 2. This Act applies only to a contract entered into |
|
or renewed on or after the effective date of this Act. |
|
SECTION 3. This Act takes effect September 1, 2011. |
