A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Texas Department of Motor Vehicles |
|
|
to contract with certain entities to provide a department service. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 1001, Transportation Code, |
|
|
is amended by adding Section 1001.007 to read as follows: |
|
|
Sec. 1001.007. AUTHORITY TO CONTRACT. (a) The department |
|
|
may contract with a private entity to wholly or partly provide a |
|
|
service otherwise provided by the department if the department |
|
|
determines that the private entity can provide the service more |
|
|
efficiently than the department. |
|
|
(b) In making a determination under Subsection (a), the |
|
|
department shall consider the cost to the state of contracting for |
|
|
the provision of the service from the private entity. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
