A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the regulation of fireworks in areas annexed by a |
|
|
municipality for limited purposes. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 43.002, Local Government Code, is |
|
|
amended by adding Subsection (e) to read as follows: |
|
|
(e) A regulation relating to the sale and use of fireworks |
|
|
is subject to the restrictions in Section 43.133. |
|
|
SECTION 2. Subchapter F, Chapter 43, Local Government Code, |
|
|
is amended by adding Section 43.133 to read as follows: |
|
|
Sec. 43.133. SALE OR USE OF FIREWORKS IN ANNEXED AREA. A |
|
|
municipality that annexes an area for limited purposes under this |
|
|
subchapter may not prohibit the sale or use of fireworks in the |
|
|
area. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
