A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to reporting donations received by a school district and |
|
|
public school campus. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 11, Education Code, is |
|
|
amended by adding Section 11.1561 to read as follows: |
|
|
Sec. 11.1561. REPORT OF DONATIONS. (a) A school district |
|
|
shall annually report all monetary and nonmonetary donations |
|
|
received by the district and each school campus in the district in |
|
|
the manner specified by the commissioner. The report must be |
|
|
submitted through the Public Education Information Management |
|
|
System (PEIMS) and include a statement of: |
|
|
(1) the amount of any monetary donation; |
|
|
(2) the fair market value and a description of any |
|
|
nonmonetary donation; |
|
|
(3) the name and location of the school campus, if the |
|
|
donation was made to a campus; and |
|
|
(4) any restrictions or conditions placed on the |
|
|
donation by the donor. |
|
|
(b) A report under this section must be posted on the |
|
|
Internet website of the school district and school campus, if |
|
|
applicable. |
|
|
SECTION 2. This Act applies beginning with the 2011-2012 |
|
|
school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
