A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the requirement of orange frames on certain speed limit |
|
signs erected by a municipality. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 544, Transportation Code, is amended by |
|
adding Section 544.013 to read as follows: |
|
Sec. 544.013. ORANGE FRAME FOR CERTAIN SPEED LIMIT SIGNS. |
|
(a) The governing body of a municipality that erects a sign giving |
|
notice of an altered speed limit on a highway or street under the |
|
municipality's jurisdiction shall install and maintain a frame |
|
behind the sign until the 91st day after the date the sign is |
|
erected. |
|
(b) The frame must: |
|
(1) have an orange reflective background; |
|
(2) contain the word "NEW"; and |
|
(3) be consistent with the manual and specifications |
|
adopted under Section 544.001. |
|
(c) It is not a defense to prosecution of an offense under |
|
Subchapter H, Chapter 545, that the frame required by Subsection |
|
(a) was not installed. Noncompliance with Subsection (a) by the |
|
governing body of a municipality is not admissible in the trial of |
|
the offense. |

SECTION 2. This Act takes effect September 1, 2011. |
