A BILL TO BE ENTITLED
 
AN ACT
  relating to the requirement of orange frames on certain speed limit
  signs erected by a municipality.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 544, Transportation Code, is amended by
  adding Section 544.013 to read as follows:
         Sec. 544.013.  ORANGE FRAME FOR CERTAIN SPEED LIMIT SIGNS.  
  (a)  The governing body of a municipality that erects a sign giving
  notice of an altered speed limit on a highway or street under the
  municipality's jurisdiction shall install and maintain a frame
  behind the sign until the 91st day after the date the sign is
  erected.
         (b)  The frame must:
               (1)  have an orange reflective background;
               (2)  contain the word "NEW"; and
               (3)  be consistent with the manual and specifications
  adopted under Section 544.001.
         (c)  It is not a defense to prosecution of an offense under
  Subchapter H, Chapter 545, that the frame required by Subsection
  (a) was not installed. Noncompliance with Subsection (a) by the
  governing body of a municipality is not admissible in the trial of
  the offense.
         SECTION 2.  This Act takes effect September 1, 2011.
