A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to storage of local government records by the Texas State |
|
Library and Archives Commission. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 441.168, Government Code, is amended to |
|
read as follows: |
|
Sec. 441.168. MICROFILMING AND STORING LOCAL GOVERNMENT |
|
RECORDS. (a) On request of a local government, the director and |
|
librarian may provide for the microfilming or storage of the local |
|
government records of that local government. Local government |
|
records are open to the director and librarian for that purpose. |
|
(b) The commission shall establish fees for the |
|
microfilming and storage of local government records in amounts |
|
sufficient to cover the costs of administering and expanding the |
|
microfilming and storage services of the records management |
|
division in the state library for the purpose of implementing |
|
Subsection (a). The fees received under this section shall be |
|
deposited in the state treasury in an account to be used only for |
|
the costs of administering [administrating] and expanding |
|
microfilming and storage services. |
|
(c) The director and librarian may allow the state records |
|
center to provide for the economical and efficient storage, |
|
accessibility, protection, and final disposition of inactive and |
|
vital local government records under this section. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
