A BILL TO BE ENTITLED
 
AN ACT
  relating to local governments that may consider a bidder's
  principal place of business when awarding a contract.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 271.905(a), Local Government Code, is
  amended to read as follows:
         (a)  In this section, "local government" means a
  municipality [with a population of 200,000 or less], a county [with
  a population of 400,000 or less], or another political subdivision
  authorized under this title to purchase real property or personal
  property that is not affixed to real property. The term does not
  include a school district.
         SECTION 2.  Section 271.9051(a), Local Government Code, is
  amended to read as follows:
         (a)  This section applies only to a municipality [with a
  population of less than 250,000] that is authorized under this
  title to purchase real property or personal property that is not
  affixed to real property.
         SECTION 3.  The changes in law made by this Act apply only to
  a contract for which the initial notice soliciting bids is given on
  or after the effective date of this Act. A contract for which the
  initial notice soliciting bids is given before that date is
  governed by the law in effect when the initial notice is given, and
  the former law is continued in effect for that purpose.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
