A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to the use of seclusion by community centers. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 534, Health and Safety |
|
|
Code, is amended by adding Section 534.0156 to read as follows: |
|
|
Sec. 534.0156. USE OF SECLUSION. (a) For purposes of this |
|
|
section, "seclusion" has the meaning assigned by Section 322.001, |
|
|
Health and Safety Code. |
|
|
(b) The executive commissioner of the Health and Human |
|
|
Services Commission shall adopt rules that allow a community center |
|
|
to use seclusion during an emergency behavioral intervention on a |
|
|
person who is receiving crisis intake services from the center. The |
|
|
rules must conform to rules adopted under Chapter 322 to the extent |
|
|
practicable. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
