A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to an insurance company's access to and removal of a motor |
|
|
vehicle stored in a vehicle storage facility. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 2303, Occupations Code, is |
|
|
amended by adding Section 2303.1601 to read as follows: |
|
|
Sec. 2303.1601. ACCESS TO AND REMOVAL OF VEHICLE BY |
|
|
INSURANCE COMPANY. (a) A vehicle storage facility may not refuse |
|
|
to allow access to a vehicle for an inspection by, or refuse to |
|
|
release a vehicle to, an insurance company that is authorized by the |
|
|
owner of the vehicle to inspect or remove the vehicle under a claim |
|
|
of loss on the vehicle. |
|
|
(b) The commission shall adopt rules specifying the |
|
|
documentation that an insurance company must present to a vehicle |
|
|
storage facility when seeking access to a vehicle described by |
|
|
Subsection (a) to inspect or remove the vehicle. |
|
|
SECTION 2. Not later than December 1, 2011, the Texas |
|
|
Commission of Licensing and Regulation shall adopt rules to |
|
|
implement Section 2303.1601, Occupations Code, as added by this |
|
|
Act. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
