A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of the Texas Animal Health Commission to
  set and collect fees.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 161.060, Agriculture Code, is amended to
  read as follows:
         Sec. 161.060.  AUTHORITY TO SET AND COLLECT [INSPECTION]
  FEES. (a)  The commission may charge a fee, as provided by
  commission rule, for an inspection made by the commission.
         (b)  The commission by rule may set and collect a fee for any
  service provided by the commission. The commission may not collect
  more than $2 million in fees under this section during a biennium.
         (c)  A fee collected under this section shall be deposited in
  a dedicated account in the general revenue fund to be used only for
  the purpose for which the fee was collected.
         SECTION 2.  This Act takes effect September 1, 2011.
