A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Texas Animal Health Commission to |
|
|
set and collect fees. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 161.060, Agriculture Code, is amended to |
|
|
read as follows: |
|
|
Sec. 161.060. AUTHORITY TO SET AND COLLECT [INSPECTION] |
|
|
FEES. (a) The commission may charge a fee, as provided by |
|
|
commission rule, for an inspection made by the commission. |
|
|
(b) The commission by rule may set and collect a fee for any |
|
|
service provided by the commission. The commission may not collect |
|
|
more than $2 million in fees under this section during a biennium. |
|
|
(c) A fee collected under this section shall be deposited in |
|
|
a dedicated account in the general revenue fund to be used only for |
|
|
the purpose for which the fee was collected. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
