A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to deceptive trade practices relating to the advertisement |
|
|
of certain goods. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 17.46, Business & Commerce Code, is |
|
|
amended by adding Subsection (e) to read as follows: |
|
|
(e) A person is presumed to engage in a false, misleading, |
|
|
or deceptive act or practice described by Subsection (b)(10) if: |
|
|
(1) the majority of the person's inventory consists of |
|
|
oriental rugs; and |
|
|
(2) the person advertises oriental rugs at a specified |
|
|
reduced price without disclosing how many rugs are available for |
|
|
purchase at that price. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
