A BILL TO BE ENTITLED
 
AN ACT
  relating to the display of owner information on and taxes and fees
  applicable to certain coin-operated machines.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 2153, Occupations Code, is
  amended by adding Section 2153.1591 to read as follows:
         Sec. 2153.1591.  DISPLAY OF OWNER INFORMATION. An owner of a
  coin-operated machine subject to this chapter shall prominently
  display the owner's name, address, and phone number on each
  coin-operated machine exhibited or displayed in this state.
         SECTION 2.  Section 2153.451(b), Occupations Code, is
  amended to read as follows:
         (b)  As provided by Section 1(f), Article VIII, Texas
  Constitution, the [The] rate of the tax may not exceed one-half
  [one-fourth] of the rate of the tax imposed under Section 2153.401.
         SECTION 3.  Section 2153.453, Occupations Code, is amended
  to read as follows:
         Sec. 2153.453.  SEALING AUTHORIZED; RELEASE FEE. A county or
  municipality that imposes an occupation tax on a coin-operated
  machine may:
               (1)  seal a coin-operated machine if the tax imposed is
  not paid; and
               (2)  charge a fee of not more than $15 [$5] for the
  release of a sealed coin-operated machine.
         SECTION 4.  Section 2153.403, Occupations Code, is repealed.
         SECTION 5.  Notwithstanding Section 2153.1591, Occupations
  Code, as added by this Act, the owner of a coin-operated machine is
  not required to comply with that section until January 1, 2012.
         SECTION 6.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
